3-13 FACULTY EMPLOYMENT POLICIES
13.1 OUTSIDE PROFESSIONAL OR SUPPLEMENTARY EMPLOYMENT
13.1.1 Participation in professional or creative activities such as consulting, research, lecturing, etc., is encouraged as long as such activities are not incompatible with the faculty member's Dixie State College academic assignments.
13.1.2 Although supplementary employment is permissible, it is discouraged if it interferes with the faculty member's fulfillment of professional responsibilities to the College.
13.1.3 Any faculty member engaged in providing compensated outside professional or scholarly service or other supplementary employment shall inform the President in writing of the nature of such service. The faculty member should also inform those who engage him/her that he/she is not acting in the name of the College and that the College is not a party to the contract nor liable for any actions of the faculty member.
13.1.4 In negotiation for outside compensated services, or in the fulfillment of these services, the faculty member shall not use Dixie State College stationery or forms in any manner, nor should he/she use college facilities, personnel, equipment, computers, software, supplies or services in fulfilling his/her outside obligations.
13.2 COMMUNITY/CIVIC SERVICE
13.2.1 Since it is desirable that there be a harmonious relationship between the college and the community, faculty members are urged to take an active part in worthwhile community and civic affairs. Faculty participation in such activities should not, however, be permitted to interfere with academic responsibilities.
13.3 PHYSICAL EXAMINATIONS
13.3.1 The President may require any faculty member to obtain a physical examination from a licensed physician if doubt exists as to the ability of the employee to meet reasonable physical and mental health requirements of the position. If a mental examination is deemed necessary, this examination will be done by a qualified, licensed psychiatrist.
13.3.2 The physician's report to the President shall contain the medical history and the record of health examination.
13.3.3 The cost of physical examination requested by the college shall be borne by the college. The physician(s) shall be selected jointly by the President and the faculty member.
13.3.4 The President reserves the right to adopt such health standards as conditions to employment or continuation thereof as may be necessary to insure the health, safety, and welfare of students.
13.3.5 In any case where the question of an employee's health is an issue with reference to his/her continued employment, the medical opinion of three qualified physicians shall be the final and determining judgment.
13.4 RESIGNATIONS AND TERMINATIONS
13.4.1 A faculty member who desires to resign at the end of the current contract period shall submit in writing to the President, preferably by March 1 but no later than seven (7) days after contracts are issued for the following year, notification of his/her resignation. If the President is not notified by that time, it is agreed that employment will continue for the following year.
13.4.2 A faculty member who desires to terminate employment during the contract period shall so notify the President by letter as soon as he/she makes the decision to terminate. The employee will be released from contract responsibilities only upon recommendation of the President and approval of the Board of Trustees.
13.4.3 Because active duty of the faculty member does not correspond directly to the number of pay periods, if the faculty member's services are voluntarily terminated prior to the contract termination date, the faculty member will return to the College any overpayment of salary within thirty (30) calendar days after termination.
13.4.4 When a faculty member leaves College employment, he/she should return to the division dean his/her identification card, all keys and any other items of College property issued in connection with employment. The division dean should notify the Human Resource office of compliance.
13.5.1 Normal retirement eligibility be at the end of the contract year in which the faculty member reaches age 65, or at the conclusion of 30 years of service, with optional retirement as appropriate conditions and mutual consent between the retiree and the college permit.
